the by-laws and the constitution call for goodstanding 24 mos. prior to the election to be a valid candidate for election. the same is true for appt. to office is it not? the rules state all candidates for office, johnny wouldn't be making a mistake and appt. a non-eligable person would he?

There's been a lot of TALK concerning "change" which is code for getting rid of the Perry's. The story of the Feds in the Local is a diversion from the real issue of getting rid of John and his family. The members need a few victories to build the momentum to finally rid our union of theses leaches and connivers. P.J.is a good guy. The only thing he did bad was let John Perry appoint him to the E-Board.

I believe the first and easiest effort in our quest to clean up the local is to overturn Perry's appointment of P.J., who was in fact declared ineligible to run. Any person who ran for Trustee or any member that voted has a cause of action under Herman v. American Postal Workers Union, 995 F.Supp. 1, which is a 1997 federal court case out of the District of Columbia. The Court in Herman ruled that the Union cannot undermine the members' right to vote for the candidate of their choice. Two possible arguments can be made in P.J.'s case: (1) Using "past practice," the next highest vote-getter should get appointed instead, or (2) a new election for P.J.'s trustee spot. A similar argument can be made in regard to the President's position.

A candidate for trustee or a voting member or both can start a cause of action by going directly to the Labor Department. If you do make a move, first read the Herman case and seek legal advice on how you can use it in the above instances.

After we hit Perry with this, we'll bomb him into submission with more stuff. You can't beat him any other way. He controls the books and the admission of new members, which he is actively pursuing contrary to the best interest of the established members who have been struggling for years to make ends meet. It's time to put up or shut up. So anybody with an interest, a voter or candidate, needs to step forward and get the ball rolling.

Give P.J. a break. Even if he wanted to do something it would be futile bacause he is outvoted 6-1 because of all the Perry puppets on the E-Board. The members, numbering in the 100's, outnumber the E-Board. The members need to step up in filing petitions and educating the ignorant ones which are far from lacking in 82. Because John has run a shoddy and unprofessional organization for years, he has left himself open for a multitude of lawsuits that inevitably will send him packing. By starting with challenging John's APPOINTMENT of P.J. (not the election), we can build the momentum to ultimately defeat this vermin.

the first step is to make the Eboard a true representation of the members,if anyone is ineligable they should step down.the board should do it's duty and investigate all trostees of funds and all officers and stewards to see if the best intrests of the members are being served.
